ANNEXATION - MISSISSIPPI

Enlargement and Extension of Municipal Boundaries of Town of Terry v. Town of Terry

Supreme Court of Mississippi - April 6, 2017 - So.3d - 2017 WL 1295355

Town petitioned for approval, ratification, and confirmation of annexation of five territories, and objectors answered the petition.

The Chancery Court found part of the request unreasonable, but partially granted the request. Objectors appealed.

The Supreme Court of Mississippi held that town’s annexation of two territories was reasonable.

Town’s annexation of two territories was reasonable, even though objectors stated that they wanted to continue living rural lifestyle, where spillover development in proposed annexation areas and within town occurred, town completed comprehensive water improvement project that included new well and refurbished water tower, and town’s waste water treatment facility was able to accommodate additional populations.
