REFERENDA - UTAH

Zonts v. Pleasant Grove City

Supreme Court of Utah - October 10, 2017 - P.3d - 2017 WL 4534402 - 2017 UT 71

Sponsors of ballot initiative filed petition for extraordinary relief after city attorney prepared final ballot title.

The Supreme Court of Utah held that sponsors of initiative who were challenging city attorney’s final ballot title were required to file petition for relief in the district court, rather than the Supreme Court. Residents failed to meet their burden of demonstrating they possessed no plain, speedy, and adequate remedy other than the filing of a petition directly with the Supreme Court.
