Lessee of billboards brought action against county board of supervisors and board members regarding renewal of billboard lease.

The Circuit Court dismissed action for failure to state a claim. Lessee appealed.

The Court of Appeals held that members of county board of supervisors did not engage in “walking quorum” in violation of open meetings law.

Members of county board of supervisors did not engage in “walking quorum” in violation of open meetings law regarding renewal of billboard lease, where series of e-mails sent by one supervisor concerning vote on lease renewal were one-way messages that garnered few, if any, responses from other supervisors, and supervisor only communicated with eight of the 34 supervisors who participated in vote.
