BONDS - GEORGIA

RTA Strategy, LLC v. Silver Comet Terminal Partners, LLC

Court of Appeals of Georgia - August 6, 2018 - 817 S.E.2d 720

In consolidated cases arising from alleged breach of contract to purchase airport expansion bonds, appeal was taken from orders of the trial court requiring non-parties to provide information regarding the identities of members and contributors to a social welfare organization formed to fight the addition of commercial passenger service at county airport.

The Court of Appeals held that contributors’ identities were irrelevant to county’s breach of contract claim against bond purchaser, and thus were not discoverable.

Identities of members and contributors to a social welfare organization formed to fight the addition of commercial passenger service at a county airport were not shown to be relevant to county’s breach of contract claim against purchaser of airport expansion bonds, and thus were not discoverable; the identities of the contributors would not have shown that the stated consideration for the bond purchase agreement failed in whole or in part, or that the county acted in bad faith when newly-elected commissioners passed a resolution halting airport expansion efforts.
