Browning v. Rabun County Board of Commissioners

Court of Appeals of Georgia - October 23, 2018 - S.E.2d - 2018 WL 5262192

Wife of deceased employee of county board of commissioner filed breach-of-contract and negligence claims against the board, asserting that board had failed to pay life-insurance benefits.

The trial court granted board’s motion for summary judgment as to the breach-of-contract claim and concluded that wife had withdrawn her negligence claim. Wife appealed. The Court of Appeals remanded for trial court to supplement the record.

Following remand, the Court of Appeals held that board’s sovereign immunity was not waived as to breach-of-contract claim.
