Residents of neighborhood filed petition for declaratory judgment, seeking invalidation of city’s annexation of neighborhood.

The trial court denied residents’ petition. Residents appealed.

The Court of Appeals held that no justiciable issue remained for determination, and thus case could not be kept alive for litigation of issue of residents’ voting rights.

No justiciable issue remained for determination, in neighborhood residents’ appeal from trial court’s denial of their petition for declaratory judgment seeking invalidation of city’s annexation of neighborhood, and thus case could not be kept alive for litigation of issue of residents’ voting rights, where Supreme Court, in separate appeal stemming from declaratory judgment petition brought by residents of different communities in same county as neighborhood residents, completely disposed of legal issues raised in neighborhood residents’ case prior to their appeal, which issues consisted of timeliness of the annexation, the constitutionality of local act incorporating city in which residents’ neighborhood was located, and compliance of the annexation petition with Georgia law.
