State ex rel. Wegman v. Ohio Police & Fire Pension Fund

Former firefighter filed complaint for writ of mandamus challenging decision by board of trustees of Ohio Police & Fire Pension Fund awarding an off-duty disability benefit of 12 percent of his average annual salary.

Firefighter appealed. The Court of Appeals denied the request. Firefighter appealed.

The Supreme Court of Ohio held that some evidence supported board’s off-duty disability benefit award.

Some evidence supported decision by board of trustees of Ohio Police & Fire Pension Fund to award former firefighter off-duty disability benefit of only 12 percent of his average annual salary, and therefore, mandamus would not lie; report by board’s medical advisor who conducted a file review of the evidence concluded that relator’s psychological condition did not impair him.
