Hotel whose water service had been interrupted filed suit against municipal water authority seeking to recover resulting loss of revenue, based on negligence.
The Superior Court granted water authority summary judgment. Hotel appealed.
The Supreme Court held that:
- Enacting legislation did not expressly empower municipal water authority to promulgate rule immunizing itself from liability, and
- Enacting legislation did not, by implication, empower municipal water authority to promulgate rule immunizing itself from liability.
