City of Effingham v. Diss Truck & Repair, LLC

City brought an action against nonresident truck repair limited liability company (LLC) seeking compensation for extrication services performed by city’s fire department when a semitrailer fell on top of LLC’s co-owner as he was attempting to perform a repair.

The Circuit Court determined that municipal code provision allowing municipalities to charge and collect firefighting service fees for services provided to nonresidents did not apply to extrication. City appealed.

The Appellate Court held that municipal code provision allowing cities to seek reimbursement for firefighting services provided to nonresidents applied to all services, including extrication, rendered by city’s fire department.
