Slice of Life, LLC v. Hamilton Township Zoning Hearing Board

Property owners appealed from decision of township zoning hearing board denying owners’ request to use property zoned for single-family residential use as part of transient lodging business.

The Court of Common Pleas upheld the board’s decision. Owners appealed, and the Commonwealth Court reversed. The Supreme Court granted further review.

The Supreme Court held that zoning ordinance clearly and unambiguously excluded purely transient uses of property, including short-term rental uses; overruling Shvekh v. Zoning Hearing Bd. of Stroud Twp., 154 A.3d 408, and Marchenko v. Zoning Hearing Bd. of Pocono Twp., 147 A.3d 947.
