Objector appealed township board of supervisors’ grant of conditional land use approval to natural gas company seeking to construct a processing facility.

The Common Pleas Court denied company’s motion to quash and granted company’s motion for permissive interlocutory appeal.

The Commonwealth Court held that objector to natural gas company’s land use application to township board of supervisors did not obtain party status for appeal purposes solely by submitting a letter to the board setting forth objector’s objections, where letter was not made part of the record before the board, so the board could not consider letter in deliberations; overruling Orie v. Zoning Hearing Bd. of Borough of Beaver, 767 A.2d 623.
