Furniture deliveryperson who had been shot and injured while making delivery inside county police officer’s home, and relatives of second deliveryperson who had been shot and killed in same incident, brought action against county, alleging numerous tort claims and seeking damages for personal injuries and wrongful death.
The court of special appeals held that:
- County was entitled to governmental immunity from direct tort claims;
- Officer was not acting within scope of employment in shooting deliverypersons; and
- Evidence officer’s health history and prior violent acts was not admissible.
