City and county sued bank, a mortgagee of record, under Slum Clearance and Redevelopment Act to recover costs associated with the demolition of certain property in the county.
The Chancery Court granted bank’s motion for judgment on the pleadings, thereby dismissing the lawsuit. Plaintiffs appealed.
The Court of Appeals held that under the Act, “owner” is defined explicitly to include mortgagees of record, for purposes of liability on demolition costs.
