County sought declaratory judgment that certain county employees who were members of union were not eligible for full pension benefits under ordinance extending benefits to employees “not covered by the terms of a collective bargaining agreement.”
The Circuit Court granted summary judgment to union. County appealed, and the Court of Appeals affirmed. County filed petition for review, which was granted.
The Supreme Court held that ordinance applied to members of union whose collective bargaining agreement with county had expired.
