Town of Rib Mountain v. Marathon County

Supreme Court of Wisconsin - May 16, 2019 - N.W.2d - 2019 WL 2127629

Town brought declaratory judgment action against county, alleging county would exceed its authority if it implemented a uniform addressing system in all unincorporated areas of the county.

The Circuit Court denied town’s claims for declaratory relief. Town appealed. The Court of Appeals reversed. County filed petition for review.

The Supreme Court held that statute conferring authority on counties to establish rural naming or numbering system for towns does not restrict county’s authority to only rural areas within towns.
