County brought action against property owners, real estate developer, and city officials challenging city’s annexation of previously unincorporated property.
The Superior Court entered summary judgment upholding annexation’s validity, and county appealed.
The Court of Appeals held that:
- Annexation complied with statutory 50-foot boundary requirement;
- Annexation was not prohibited spoke and stem annexation;
- Annexation complied with statutory requirement that annexation involve entire parcels of real property owned by persons seeking annexation; and
- Annexation complied with statutory requirement that annexation comply with annexing municipality’s minimum size requirements for occupiable structures.
